1. Scope and acceptance
1.1 These Terms and Conditions (the “Terms”) govern the rights and obligations between the Institute and any customer, applicant, student, payer or other person ordering or paying for services, fees, goods or related items from the Institute (the “Buyer”).
1.2 These Terms apply to orders and payments made through the Institute’s website at eiasm.cz and its subdomains, including the e-shop, online payment interfaces and the learning management system at moodle.eiasm.cz. The Institute does not use any unrelated external domain for the sale of its services or for access to official online study materials, unless expressly stated in a written contract with the Buyer.
1.3 These Terms may also apply where they are referred to in a written contract, invoice, order form, admission document or other document issued by the Institute.
1.4 By placing an order, making a payment, signing a contract or otherwise confirming acceptance of these Terms, the Buyer agrees to be bound by them.
1.5 If a written contract contains provisions that differ from these Terms, the written contract prevails to the extent of the difference.
2. Consumer and business customers
2.1 A consumer is a natural person who acts outside the scope of their business activity or independent profession.
2.2 A business customer is a legal person or a natural person acting in the course of their business activity or independent profession, including where the order is made using business identification details such as an identification number, VAT number or business name.
2.3 Mandatory consumer protection rules apply to consumers. Business customers are not entitled to consumer withdrawal rights unless the Institute expressly agrees otherwise in writing.
3. Nature of services, fees and items offered
3.1 The Institute offers different types of services, fees and items. Refund rules may differ depending on their nature.
3.2 Educational services and study programmes
Tuition and course-related payments usually represent an educational service. This may include admission or enrolment handling, access to a study programme, academic or administrative support, assessment, feedback, examinations, certification processes and access to the Institute’s online study environment.
3.3 Digital content and online learning materials
Educational services may include digital content and online learning materials, such as access to the learning management system at moodle.eiasm.cz, online course rooms, study materials, videos, documents, presentations, assignments, tests, quizzes, recordings and similar resources. Such content is supplied electronically.
3.4 Non-refundable administrative and third-party services
Certain fees are non-refundable by their nature once the relevant service has been initiated or performed, especially where they relate to administrative processing, third-party services, official document handling, delivery or other one-time processing.
These may include, in particular:
- application fees;
- administrative processing fees;
- apostille, superlegalization, notarisation, certification, verification or similar official document services;
- courier and delivery services, including DHL or similar providers;
- document preparation, document replacement, duplicate issuance and other study-related administrative services;
- fees paid to or incurred with third parties where the service has already been requested, initiated or performed.
3.5 The exact nature of a fee or service may be stated in the e-shop, invoice, contract, admission document, price list or other payment description.
4. Orders and contract formation
4.1 The Buyer may place an order through the Institute’s website, e-shop, payment interface, written contract, order form, invoice, email communication or another method accepted by the Institute.
4.2 Information shown on the website or e-shop is for information purposes and does not constitute a binding offer unless expressly stated otherwise. The Institute may refuse or cancel an order where the order is incomplete, incorrect, technically defective, fraudulent, impossible to perform or otherwise inconsistent with these Terms or applicable law.
4.3 Before submitting an online order, the Buyer should check the order details, selected item, price, payer details and payment method. The Buyer is responsible for the accuracy of the information provided.
4.4 The contract is concluded when the Institute accepts the order, confirms access, issues an invoice or otherwise confirms that the order or payment has been accepted. For study programmes, additional admission or enrolment requirements may apply.
5. Prices and payment
5.1 Prices are stated in the relevant order form, e-shop, price list, invoice, contract or payment request. Unless expressly stated otherwise, prices are final from the Buyer’s perspective. If VAT or another tax becomes applicable, the Institute may adjust invoices and payment documents in accordance with applicable law.
5.2 Available payment methods may include card payment, bank transfer, invoice-based payment or another payment method offered by the Institute.
5.3 Card payment is normally processed immediately and may result in faster confirmation and activation of the relevant service or access. Bank transfer or invoice-based payment may take longer to process.
5.4 The Institute does not charge a separate fee merely for the use of a payment card where such fee is prohibited by applicable law.
5.5 The Buyer must pay the correct amount, use the required payment reference or variable symbol where applicable, and ensure that the payment can be matched to the relevant order or invoice. The Institute is not responsible for delays caused by incorrect payment references or incomplete payer information.
6. Activation of services and access to Moodle
6.1 After payment or other acceptance by the Institute, the Institute may activate the relevant service, student account, LMS access or digital content without undue delay, especially where the Buyer chooses an immediate payment method such as card payment.
6.2 The provision of login credentials, student account access, Moodle access or access to online study materials may constitute commencement of the educational service and/or supply of digital content, regardless of the extent to which the Buyer actually uses, views, downloads or completes the materials.
6.3 The Buyer is responsible for keeping login credentials confidential and must not share access with third parties. The Institute may suspend access where there is suspected misuse, unauthorised sharing, non-payment, fraud, breach of academic integrity, breach of these Terms or another serious reason.
7. Consumer withdrawal rights and refunds
7.1 General consumer withdrawal period
Where the Buyer is a consumer and the contract is concluded remotely or outside business premises, the Buyer may have the statutory right to withdraw from the contract within 14 days, unless an exception or limitation applies under applicable law.
7.2 Immediate commencement of educational services
If the consumer requests or agrees that the educational service should begin before the end of the 14-day withdrawal period, and the service begins during that period, the consumer acknowledges that in the event of withdrawal they may be required to pay a proportionate part of the price corresponding to the service provided up to the moment of withdrawal.
7.3 Digital content and Moodle access
If the consumer requests or agrees to the supply of digital content before the end of the 14-day withdrawal period and acknowledges the legal consequences of such supply, the consumer may lose the right to withdraw from the contract in relation to the digital content that has been supplied or made available, in accordance with applicable law.
For the purposes of these Terms, digital content is considered supplied or made available when the Institute enables access to Moodle, an online course room, study materials, downloadable documents, videos, tests, assignments or other online learning resources, even if the consumer does not actually view, download or complete any or all available materials.
7.4 Non-refundable administrative and third-party services
Fees for services listed in Section 3.4 are not refundable once the relevant service has been initiated or performed. This applies in particular where the Institute has started administrative processing, requested a third-party service, ordered courier delivery, prepared official documents, submitted documents for apostille or superlegalization, or otherwise acted on the Buyer’s request.
7.5 Refund calculation
Where a refund is due, the Institute may take into account the nature of the purchased item, whether the service has started, whether digital content has been made available (e.g. through provision of Moodle credentials), whether administrative or third-party services have been initiated or performed, and any applicable mandatory consumer protection rules. The Institute does not describe any deduction as a payment-card fee; refund decisions are based on the nature and extent of the service or content already provided and on applicable law.
7.6 Method of refund
Where required by law, refunds to consumers are made using the same payment method that the consumer used for the original transaction, unless the consumer expressly agrees to another method and does not incur additional costs as a result. For business customers, refunds may be made by bank transfer or another method agreed by the Institute.
8. Business customers
8.1 Business customers (e.g. companies who pay tuition for natural persons) do not have the statutory 14-day consumer withdrawal right. Refunds, cancellations and changes for business customers are governed by the contract, invoice, these Terms and any specific written agreement with the Institute.
8.2 Unless the Institute agrees otherwise, administrative fees, third-party services, application fees, document services, delivery services, tuition and course-related payments made by business customers are non-refundable once the order has been accepted, the service has been initiated, access has been activated or the third-party service has been requested.
9. Delivery, access and performance
9.1 Educational services and digital content are normally delivered electronically through eiasm.cz, its subdomains, Moodle, email or other online systems used by the Institute.
9.2 Physical documents or goods, where applicable, may be delivered by postal service, courier, personal collection or another method agreed with the Buyer.
9.3 If delivery or performance depends on information, documents, cooperation or action from the Buyer, the Institute is not responsible for delays caused by the Buyer’s failure to provide such cooperation.
10. Defects, complaints and service issues
10.1 The Buyer may submit complaints or service issues by email to info@eiasm.cz.
10.2 The Buyer should describe the problem clearly and provide order number, invoice number, payment reference, student number or other information allowing the Institute to identify the relevant order or service.
10.3 Consumer rights arising from defective performance are governed by applicable law. The Institute will handle complaints in accordance with Czech law and applicable consumer protection rules.
10.4 The Institute is not responsible for service issues caused by the Buyer’s device, internet connection, browser settings, incorrect login details, unauthorised account sharing or failure to follow reasonable technical instructions.
11. Study-specific provisions
11.1 The Institute offers professional and continuing education services. Unless expressly stated otherwise in a specific programme description or contract, the Institute’s professional degree courses are not academic degrees recognised within the Czech higher education system.
11.2 Study duration, access period, deadlines, assessment rules, extensions, certification requirements and academic requirements may be specified in the relevant programme description, student handbook, admission documents, contract or Moodle course information.
11.3 The Buyer acknowledges that successful completion may depend on meeting academic, administrative and payment requirements. Payment alone does not guarantee successful completion or issuance of a certificate if academic or administrative requirements are not fulfilled.
12. Intellectual property and permitted use
12.1 Study materials, online content, videos, documents, tests, assignments, course structure, website content and other materials provided by the Institute are protected by intellectual property rights.
12.2 The Buyer may use the materials only for personal study purposes or for the purpose expressly agreed with the Institute. The Buyer must not copy, share, resell, publish, distribute, upload, screen-record, systematically download or otherwise misuse the materials without the Institute’s prior written consent.
12.3 Access to Moodle and online materials is personal and may not be transferred to another person.
13. Data protection and cookies
13.1 The Institute processes personal data in accordance with its Privacy and Cookie Policy, available on the Institute’s website.
13.2 The Buyer acknowledges that use of the website, e-shop, Moodle and online study systems may involve processing of personal data necessary for account management, provision of services, payments, security, legal compliance and communication.
14. Communication
14.1 The Institute may communicate with the Buyer by email, through Moodle, through the student account, by notices on the website or by other reasonable means.
14.2 Notices to the Institute should be sent to info@eiasm.cz unless another contact is expressly provided for a specific matter.
14.3 The Buyer is responsible for keeping contact details up to date and for checking email, including spam or junk folders, and Moodle or student account notifications where applicable.
15. Out-of-court dispute resolution and supervision
15.1 Consumer complaints may be addressed to the Institute at info@eiasm.cz.
15.2 The competent authority for out-of-court resolution of consumer disputes in the Czech Republic is the Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 567/15, 120 00 Prague 2, Czech Republic, website: adr.coi.cz.
15.3 Supervision in the area of personal data protection is carried out by the Office for Personal Data Protection (Úřad pro ochranu osobních údajů).
16. Governing law
16.1 These Terms and contracts concluded with the Institute are governed by Czech law.
16.2 Where the Buyer is a consumer habitually resident in another country, mandatory consumer protection rights that cannot be contractually excluded may still apply.
17. Changes to the Terms
17.1 The Institute may update these Terms from time to time. The current version is available on the Institute’s website.
17.2 Unless mandatory law provides otherwise, changes do not affect rights and obligations that arose before the effective date of the updated Terms.
18. Final provisions
18.1 If any provision of these Terms is invalid or ineffective, the remaining provisions remain valid and effective. The invalid or ineffective provision shall be replaced by a valid provision that most closely reflects the purpose of the original provision.
18.2 These Terms are prepared in English. If the Institute provides a translation, the English version prevails unless expressly stated otherwise.
18.3 These Terms are effective from 1 January 2026.
